1Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of simbacksonsbakery.com (the "Website") and any purchase you make from Simbackson's Bakery ("Simbackson's Bakery", "we", "us" or "our"). By browsing the Website, creating an account or placing an order, you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Website.

2Eligibility & Your Account

You must be at least 18 years old, or use the Website under the supervision of a parent or guardian, and be legally able to enter into a contract under Indian law.

If you create an account, you must give accurate information and keep your password confidential. You are responsible for all activity under your account. Tell us immediately if you suspect unauthorised use.

3Products, Allergens & Food Information

• We try to display ingredients, nutrition and allergen information accurately on each product page, but recipes and suppliers can change. Please always check the label on the product you receive.
• Product photos are for illustration. Handmade products — especially cakes and desserts — may differ slightly in colour, decoration, shape and size.
• Our protein bars and other food products are foods, not medicines. They are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, nursing, have a medical condition or are on a special diet, please consult your doctor before consuming them.
• Products marked "Coming Soon" cannot be ordered yet. Launch timing shown on the Website is only an estimate.

4Orders, Pricing & Payment

• All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise. Delivery charges, if any, are shown before you pay.
• Placing an order is an offer to buy. A contract is formed only when we confirm your order. We may decline or cancel an order — for example if an item is unavailable, we cannot deliver to your area, there is a pricing or description error, or we suspect fraud — and we will refund any amount you have paid.
• Payment must be made through the payment methods offered at checkout. Payments are handled by third-party payment partners, whose own terms apply. We never see or store your full card or UPI credentials.
• Discount codes and offers are valid only for the period and conditions stated, cannot be combined unless we say so, have no cash value, and may be withdrawn at any time.
• We may limit quantities on any order.

5Delivery

• We deliver only to the locations and PIN codes available at checkout. Delivery times shown are estimates, not guarantees, and can be affected by weather, traffic, festivals and courier delays.
• Please give a complete, correct address and a phone number on which you can be reached. We are not responsible for failed or delayed delivery caused by wrong details, an unavailable recipient or a locked premises.
• Fresh products such as cakes are perishable. If delivery fails because the recipient cannot be reached or refuses delivery, the order may be cancelled without a refund.
• Risk in the products passes to you when they are delivered. Please inspect the package on delivery and follow the steps in our Refund Policy if anything is wrong.

6Custom & Personalised Orders

For custom, themed or personalised orders (such as a message or design on a cake), we will follow your instructions as closely as we reasonably can, but handmade decoration can vary slightly and exact matches to reference images cannot be guaranteed. Custom orders can be cancelled only before preparation begins. We may ask for extra lead time, advance payment or a minimum order value for such orders.

7Storage & Consumption

Quality depends on proper storage after delivery. Follow the storage and "consume by" instructions on the product page or label. As a general rule, cakes, cheesecakes and other fresh desserts must be refrigerated and eaten within the time stated, and protein bars should be kept in a cool, dry place away from direct sunlight. We are not liable for spoilage caused by storage that does not follow our instructions, or for products eaten after the stated date.

8Cancellations, Refunds & Replacements

Because our products are food, most of them cannot be returned. Cancellations, refunds and replacements are handled as described in our Refund Policy, which forms part of these Terms.

9Reviews & Content You Submit

If you post a review, rating, photo or other content on the Website, you confirm that it is honest, based on your own experience, and does not break any law or anyone's rights. You give us a free, non-exclusive, worldwide right to display, reproduce and use that content on the Website and in our marketing. We may remove any content that is abusive, misleading, unlawful, or that we think is not genuine.

10Acceptable Use

You agree not to:

• use the Website for any unlawful, fraudulent or abusive purpose;
• place false or prank orders, or misuse discount codes;
• attempt to hack, overload, scrape or interfere with the Website or its security;
• upload viruses or harmful code, or impersonate another person; or
• copy or resell our content or products without our written permission.

11Intellectual Property

All content on the Website — including the name and logo, text, recipes, product descriptions, photographs, graphics and design — belongs to Simbackson's Bakery or its licensors and is protected by Indian intellectual property laws. You may view and print pages for your personal, non-commercial use. Any other use needs our prior written consent.

12Disclaimer & Limitation of Liability

• The Website and its content are provided on an "as is" and "as available" basis. We do not promise that the Website will always be uninterrupted or error-free.
• To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Website or our products.
• Our total liability for any claim relating to an order is limited to the amount you paid for that order.
• Nothing in these Terms limits any right you have as a consumer under applicable law, including the Consumer Protection Act, 2019, or our liability for anything that cannot be limited by law.
• We are not responsible for delays or failure caused by events beyond our reasonable control, such as natural disasters, strikes, government action, power or internet failures.

13Privacy

How we collect and use your personal information is explained in our Privacy Policy.

14Governing Law & Disputes

These Terms are governed by the laws of India. We encourage you to contact us first so we can try to resolve any complaint informally. If a dispute cannot be resolved, it will be subject to the exclusive jurisdiction of the courts at Your City, Your State, without affecting any right you may have to approach a consumer forum with jurisdiction over you.

15Changes to These Terms

We may change these Terms from time to time. The updated Terms apply from the "Last updated" date shown at the top of this page. Orders are governed by the Terms in force when the order was placed. If any part of these Terms is found to be unenforceable, the rest will continue to apply.
